This Master Terms of Service Agreement (the “Agreement”) is entered into by and between FOR TEX IDEAS, LLC, a limited liability company organized under the laws of the State of New Mexico, United States (hereinafter referred to as “FORTEX,” the “Company,” or the “Platform”), and the individual accessing the Platform (hereinafter referred to as the “Client,” “Partner,” “Member,” or “User”).
By accessing the FORTEX platform, registering a user account, or allocating capital into the Company’s infrastructure, the User expressly acknowledges that they have read, understood, and unconditionally agreed to be bound by the terms and conditions set forth in this Agreement.
PART I — Company Protections and Limitations of Liability
1. Corporate Status and Regulatory Position
1.1 FOR TEX IDEAS, LLC operates exclusively as a limited liability company. The Company is not a licensed banking institution, registered broker-dealer, investment adviser, or insured securities firm, and does not represent itself as such.
1.2 FORTEX operates as a private logistical and tariff arbitrage engine. The Company’s operations are conducted within a strictly private environment and are accessible exclusively to registered Users and their vetted referrals.
1.3 The User acknowledges that the Platform does not issue traditional dividends, equity instruments, or registered securities. Instead, allocated capital is deployed into thirty (30) day operational SLOTS that generate performance-based daily returns derived from logistical arbitrage activities.
2. Limitation of Liability and Risk Disclosure
2.1 The User expressly acknowledges that participation in cross-border arbitrage activity carries inherent and substantial risk. Capital deployed into operational SLOTS is not guaranteed, insured, or otherwise backed by any sovereign government, federal agency, deposit insurance scheme, or third-party guarantor.
2.2 Past performance data and historical yield metrics do not constitute a representation, warranty, or guarantee of future results. The User is strongly advised to allocate only such capital as they are financially prepared to lose in full.
2.3 To the maximum extent permitted by applicable law, FORTEX, its officers, directors, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the User’s participation in the Platform.
3. Third-Party Infrastructure and Force Majeure
3.1 While capital routed through FORTEX is managed with operational precision, the Company shall not be held liable for losses, delays, or service interruptions arising from external infrastructure failures. Such excluded events include, without limitation:
- Blockchain network congestion or protocol-level disruption;
- Failure, suspension, or malfunction of third-party payment gateways;
- Hardware failures, data center outages, or telecommunications disruption affecting external service providers; and
- Delays in withdrawal processing or profit distribution attributable to the foregoing.
3.2 In the event of extraordinary and unforeseen circumstances — including but not limited to catastrophic geopolitical conflict, macroeconomic collapse, material regulatory action, or global network outage — the Company reserves the unilateral right to suspend, restructure, or permanently discontinue Platform operations to preserve the integrity of the core system. No liability shall accrue to FORTEX as a result of any such action taken in good faith.
4. Finality of Transactions
4.1 Owing to the cryptographic nature of the Company’s payment infrastructure, all Bitcoin network deposits, SLOT activations, withdrawals, and commission distributions are final and irreversible. FORTEX reserves the right to decline any reversal request in its sole discretion.
4.2 Notwithstanding the foregoing, a User may submit a request to reverse a capital allocation within twenty-four (24) hours of the initial funding execution. Such requests are not granted as of right; the Company shall investigate the operational status of the allocated funds and shall retain ultimate discretion to approve or deny the request based on the logistical mobility of the capital at the time of the request.
5. Enforcement and Termination Rights
5.1 FORTEX administration reserves the absolute right to refuse any account registration or capital allocation, without obligation to provide prior warning, justification, or explanation to the applicant.
5.2 Any confirmed breach of this Agreement entitles FOR TEX IDEAS, LLC to immediately terminate the offending User’s account, nullify all future service rights, and freeze any active SLOTS and associated capital pending resolution.
5.3 The operation of multiple accounts, or the sharing of infrastructure for the purpose of exploiting the affiliate commission structure, is strictly prohibited absent prior written consent from administration. Automated detection of such activity may result in forfeiture of associated capital and termination of all related accounts.
6. Modification of Terms and Yield Parameters
6.1 FORTEX operates as a fluid arbitrage platform. To preserve systemic integrity and protect the User base, the Company reserves the right to modify SLOT yield percentages, affiliate commission structures, operational durations, and the terms of this Agreement at any time.
6.2 The User bears sole responsibility for periodically reviewing this Agreement. Continued use of the Platform following any modification constitutes the User’s acceptance of the revised terms.
7. Intellectual Property and Authorized Representation
7.1 All logistical data, site architecture, written content, and communications originating from FORTEX are proprietary to the Company and protected by applicable copyright and intellectual property law.
7.2 Only verified, officially designated administrators are authorized to act on behalf of FOR TEX IDEAS, LLC. Any attempt by a User to impersonate Company administration, solicit funds in the Company’s name, or distribute proprietary information without authorization constitutes a material breach and shall result in immediate termination.
PART II — User Obligations and Acknowledgments
8. Eligibility and Voluntary Participation
8.1 The User certifies that they have attained the age of majority in their governing jurisdiction and are in any event no less than eighteen (18) years of age.
8.2 The User affirms that their registration and participation in the FORTEX ecosystem are entirely voluntary and free from coercion.
8.3 The User further affirms that they are acting as a sovereign individual and not on behalf of any corporate entity, government agency, or regulatory body, and that they are not gathering intelligence on behalf of any such party.
9. Account Security
9.1 The User is solely responsible for safeguarding their account credentials, including passwords, cryptographic keys, and any associated authentication factors.
9.2 FORTEX assumes no liability for any loss of capital arising from compromised credentials, shared login data, phishing, social engineering, or identity theft. The User agrees to notify the Company promptly upon discovering any unauthorized access to their account.
10. Anti-Money Laundering and Tax Compliance
10.1 The User bears full and sole responsibility for ensuring that their participation complies with all applicable anti-money laundering laws and international financial regulations. The deployment of capital derived from illicit, illegal, or sanctioned activities is strictly prohibited.
10.2 FORTEX assumes no responsibility for the User’s jurisdictional tax obligations. The User is entirely responsible for the calculation, reporting, and settlement of any applicable taxes arising from profits generated through the Platform and shall indemnify and hold harmless FOR TEX IDEAS, LLC against any liability arising therefrom.
11. Acceptable Use and Reputation
11.1 The use of unsolicited bulk email, spam, or coercive marketing tactics employing the FORTEX name, domain, or branding is strictly prohibited.
11.2 In the event of any technical or financial discrepancy, the User shall first contact FORTEX internal support for resolution. The Company reserves the right to treat the publication of demonstrably false or malicious claims as a breach of this Agreement.
11.3 Violation of the provisions of this Section may result in suspension of account privileges and termination in accordance with Section 5.
12. Lawful Use of the Platform
12.1 The User agrees to interact with the Platform in full compliance with all applicable local, state, national, and international laws, including without limitation those governing digital assets, financial conduct, and data protection.
PART III — General Provisions
13. Data Confidentiality
13.1 All internal Platform data — including financial volumes, account balances, ledger history, and personally identifying information — shall be treated as confidential and shall not be deliberately disclosed to third parties, except as required by applicable law or valid legal process.
14. Operational Continuity
14.1 The Company and its global logistical partners remain committed to maintaining secure communication channels and Platform availability at the highest technical standards reasonably achievable.
15. Entire Agreement and Severability
15.1 This Agreement constitutes the entire understanding between the User and FOR TEX IDEAS, LLC with respect to the subject matter hereof and supersedes all prior communications, representations, or agreements, whether oral or written.
15.2 If any provision of this Agreement is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
16. Contact and Inquiries
16.1 All legal, technical, and financial inquiries shall be directed through the official FORTEX Contact portal. No other channel constitutes valid notice to the Company.
